1. Ownership and Independence

The Site is owned and operated by RUC ON RAILS LIMITED, a company incorporated in New Zealand. Its company number is 9362845 and its NZBN is 9429053041746. Its registered address is 26 Hobson Street, Suite 15587, Auckland, 1010, New Zealand.

RUCSPY is a site and brand of RUC ON RAILS LIMITED, not a separate legal entity. The company is a private commercial entity, not a public authority or charity. RUCSPY is independent of NZ Transport Agency Waka Kotahi (NZTA). It is not operated by, part of, or endorsed by NZTA.

2. A Free Public Data Service

RUCSPY makes publicly available New Zealand road user charges sales data easier to explore, compare and download. Access to the public tools and reports is free and does not require an account.

The Site does not sell RUC, take payments, issue licences or provide vehicle compliance services. Its figures are general information, not personalised legal, financial, tax or compliance advice. References or links to other RUC on Rails products do not make those products part of this service. Their own terms apply when you use them.

3. Data Source, Coverage and Revisions

Sales data is sourced from NZTA's Road User Charges - Monthly Summary. It is a national summary of recorded RUC sales, not a record of sales by RUCSPY or one agent. Source coverage, classifications, exclusions and revisions govern the figures shown.

Kilometres Sold measures distance purchased, not distance travelled during the reporting period. Licences Sold does not count unique vehicles. Regional categories refer to registered owner locations, not journey locations.

NZTA may revise historical figures, including for refunds and reversals. Reports retain the source date used to prepare them. The interactive tools may retrieve a later source revision. Newly published months and revisions depend on NZTA availability and successful processing. Publication dates, source availability and uninterrupted updates are not guaranteed.

4. Open Data and Permitted Reuse

NZTA publishes the source dataset under the Creative Commons Attribution 4.0 International licence (CC BY 4.0). You may copy, share, adapt and use that data, including commercially, subject to the licence. Credit NZ Transport Agency Waka Kotahi, link to the licence, identify any changes and do not imply endorsement.

Where RUCSPY has rights in the exported numerical summaries and accompanying data descriptions it creates from that dataset, we also make those available under CC BY 4.0. Identify RUCSPY when reusing its summaries and retain NZTA attribution. This permission covers data outputs, not our trademarks, logos or software.

Nothing in these Terms takes away permissions granted by CC BY 4.0 or imposes additional restrictions on data already obtained under that licence. Our licensing permission does not grant a right to overload the Site or a third-party data service.

5. Branding, Software and Other Content

Except for the open-data permissions above or another stated licence, rights in the Site's original branding, logos, software, design and written material belong to RUC ON RAILS LIMITED or their respective licensors. Third-party software and assets remain subject to their own licences.

You may link to reports and quote reasonable extracts with attribution where permitted by law. You must not use our branding to imply affiliation or endorsement, or present a copy of the Site as an official RUCSPY or NZTA service. The open-data commitment does not itself license the Site's source code as open-source software.

6. Acceptable Use

You may use the provided charts, downloads and public source links for legitimate research, reporting, analysis and other lawful purposes. Automated access must respect service limits and any applicable source-provider terms.

We may proportionately limit or suspend access where reasonably necessary to address misuse, security risks or excessive load. This does not revoke an open-data licence for data already obtained.

• Do not attempt unauthorised access, circumvent security controls or introduce malicious code.
• Do not deliberately overload the Site or NZTA's services, including by ignoring rate limits or repeatedly retrying blocked requests.
• Do not misrepresent the source, reporting period or meaning of data, or claim official endorsement without permission.
• Do not use the Site or communications facilities unlawfully or to infringe another person's rights.

7. Third-Party Services and Links

Interactive data queries and source downloads connect directly from your browser to NZTA's ArcGIS service. Third-party availability, terms and privacy practices apply to those interactions.

Links to NZTA, other RUC on Rails products or other organisations are provided for information or convenience. A link does not by itself imply endorsement. We do not control independent third-party websites or their content.

8. Accuracy and Availability

We take care in presenting and checking the data, but the Site is provided on an as-is and as-available basis. Source errors, omissions, delays, revisions or processing errors may occur. To the extent permitted by law, we do not warrant that every figure is complete, current or suitable for a particular purpose.

Check material decisions against the current official source and obtain appropriate professional advice where needed. We may correct or change reports and functionality, or suspend parts of the Site for maintenance, security or source changes. Our open-data commitment does not guarantee perpetual operation of the website.

9. Privacy

Personal information is handled as described in our Privacy Policy and under applicable New Zealand privacy law. The policy explains technical requests, browser-held selections and data, and communications you send to us.

10. Liability and Statutory Rights

Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability under the Fair Trading Act 1986, Consumer Guarantees Act 1993 or another law where doing so would be unlawful.

Subject to those protections and to the extent permitted by law, we are not liable for indirect or consequential loss resulting from use of or reliance on the Site, or loss arising from independent third-party services outside our reasonable control. Where a limitation is lawful and reasonable in the circumstances, our aggregate liability arising from use of this free Site is limited to NZD $1,000.

These provisions do not exclude liability that cannot lawfully be excluded, or limit a remedy or compensation that the law requires us to provide. They apply only to the extent enforceable in the circumstances.

11. Feedback and Corrections

You can send corrections, questions and feedback to contact@ruconrails.co.nz. Only provide material you are entitled to share. Please avoid personal, confidential or commercially sensitive information unless we have agreed to receive it.

We may use non-confidential feedback to improve the Site, subject to privacy law. Providing feedback does not transfer ownership of your original materials or create a payment, employment or partnership relationship.

12. Changes, Governing Law and General Terms

We may update these Terms to reflect changes to the Site, the law or its operation. We will identify the revision date and give additional notice where required by law. Changes apply prospectively and do not retrospectively remove accrued rights or permissions already granted under an open-data licence.

New Zealand law governs these Terms. Disputes may be brought in the courts of New Zealand, subject to any mandatory rights to use another competent court or statutory dispute process.

If a provision is unenforceable, it will be read down or severed only to the extent necessary. The remaining provisions continue to apply. A failure to exercise a right does not waive it. These Terms govern RUCSPY; a separate agreement for another product continues to govern that product.
